Bird & Bird advised MPS Capital Services as arranger, lending bank and agent bank in a refinancing transaction for a total of €9.75 million to fund a photovoltaic plant with a power output of about 9.6 MWp, built in the municipality of Casamassima (BA).

The plant is owned by CGE Palea Arsa, a renewable energy company associated with the Ardian investment fund.

Bird & Bird advised the bank in all project finance aspects related to the negotiation, drafting and completion of the financing documentation and the concomitant disbursement of the facility. The team was coordinated by partner Pierpaolo Mastromarini, head of the Energy & Utilities team in Italy, and led by senior associate Michele Arruzzolo, who acted as project manager with the support of associates Vincenzo Maria Giorgio, Francesco Bianco and Teresa Florio. Regulatory aspects were supervised by partner Simone Cadeddu (head of the administrative law department) together with senior associate Jacopo Nardelli and associate Chiara Tortorella.

L&B Partners Avvocati Associati advised CGE Palea Arsa and its shareholder in reviewing and negotiating the financing documentation. The team was composed of managing partner Michele Di Terlizzi, counsel Andrea Semmola, senior associate Giuseppe Candela and junior associate Carlo Maria Tealdo.

Notarial aspects were handled by Notary Public Andrea Positano De Vincentiis.
