Competition, Communication & Advertising

We advise our clients in their business and the relationship with regard to their competitors, users and consumers, and in dealing with competition, communication and advertising and antitrust issues that interfere with industrial and intellectual property law. We boast in-depth domain knowledge and offer highly specialised advisory services, even when concerning the most recent issues or legislative reforms (including the illicit copying of apps’ and websites’ “look and feel”, new forms of digital advertising, ambush marketing), both in and out of court.

STRATEGIC ADVISORY

We assist our clients in defining their advertising and corporate communication strategy (regarding, for example, advertising campaigns, radio and television commercials, social media contests, web marketing, contests and prize events), developing effective solutions aimed at defining marketing strategies in compliance with the applicable legislation.

LEGAL OPINIONS AND CONTRACTS

We support our clients drafting legal opinions and in the drafting, review and negotiation of a variety of commercial contracts including, for example, advertising agency, licensing and dissemination, sponsorship and distribution agreements, e-commerce contracts, agreements with influencers and testimonials as well as agreements governing the confidentiality of company information, regulating the access and use of such information by employees and business partners.

LITIGATION

We represent our clients before courts of law (including when seeking interim/protective measures) in relation to any conduct of unfair competition (including parasitism and copyright abuse, disparagement, infringement of trade secrets often associated with the poaching of strategic employees, violations of non-competition or exclusivity agreements, boycotting), during antitrust proceedings that involve intellectual property rights in any way, as well as in proceedings before independent authorities (such as the Italian Competition Authority and the Self-regulating Advertising Jury) in relation to unfair business practices and misleading and aggressive advertising.
